Welcome to MiraçPalm! The terms "we", "us" and "our" refer to MiraçPalm, operated by MIRAC PALM GIDA SANAYİ LİMİTED ŞİRKETİ, a limited liability company established and registered in the Republic of Türkiye, with its registered office at Saraç İshak Mah., Küçük Haydarefendi Sk., Demiröz Center No: 11, Interior Door No: 125, Fatih / Istanbul · Miraç Palm operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Miraç Palm is powered by Shopify Inc., Shopify Commerce Singapore Pte. Ltd or Shopify International Limited, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service"), describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. These Terms of Service do not limit any rights you may have under Turkish Consumer Protection Law No. 6502, the Distance Contracts Regulation, or any other non-waivable statutory rights.
1. Access and account
By agreeing to these Terms of Service, you represent that you are at least 18 years old, or that you are using the Services under the supervision of a parent or legal guardian. To use the Services, including browsing our online store or purchasing any of our products, you may be asked to provide certain information, such as your name, email address, phone number, billing, payment and delivery information. You represent and warrant that all the information you provide is correct, current and complete. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign or license your account to any other person.
2. Our products
Miraç Palm offers premium Algerian Deglet Nour dates and related food products. Dates are a natural agricultural product: their size, color, texture and sweetness may vary slightly from one harvest or batch to another, and may differ from how they appear on your screen. Such natural variations are not considered defects.
Product descriptions, ingredients, origin, net weight, storage instructions and best-before dates are stated on the product page and/or on the packaging. Please read the label carefully, especially if you have food allergies or dietary requirements. Store products in a cool, dry place away from direct sunlight unless otherwise indicated on the packaging.
All product descriptions are subject to change without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any product offered to any person or region.
3. Orders
When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your selected payment method for the total amount of your order. Before you confirm your order, you will be shown the Preliminary Information Form (Ön Bilgilendirme Formu) and the Distance Sales Contract (Mesafeli Satış Sözleşmesi), which form part of your purchase. Your order is accepted once we send you an order confirmation.
Miraç Palm may decline or cancel an order, subject to applicable law, for example if a product is out of stock, if there is a pricing error, or if we suspect fraud. If we cancel an order after payment has been collected, we will refund the full amount to your original payment method within 14 days.
You may cancel your order free of charge before it is shipped by contacting us at support@miracpalm.com. After shipment, the return and withdrawal terms in Section 4 apply.
Orders placed through this store are intended for personal or household use. For wholesale, corporate gifting or B2B orders, please contact us at support@miracpalm.com.
4. Right of withdrawal and returns
In accordance with Turkish law, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, provided the products are in their original, unopened and sealed packaging.
Under the Distance Contracts Regulation, the right of withdrawal does not apply to food products whose protective packaging or seal has been opened after delivery, as they are not suitable for return for health and hygiene reasons, nor to products that can deteriorate quickly or whose expiry date may pass.
If your order arrives damaged, defective or incorrect, please contact us as soon as possible (ideally within 48 hours of delivery) with your order number and photos, and we will offer a free replacement or a full refund. This does not limit your statutory rights regarding defective goods.

5. Prices and billing
All prices are shown in Turkish Lira (TL) and include VAT (KDV), unless otherwise stated. Shipping costs, if any, are shown at checkout before you confirm your order. The price charged will be the price in effect at the time the order is placed, as shown in your order confirmation.
Prices, discounts and promotions are subject to change without notice. Promotions may be governed by separate terms; if there is a conflict between promotion terms and these Terms of Service, the promotion terms will govern.
You agree to provide current, complete and accurate purchase and payment information. You represent and warrant that (1) you are authorized to use the payment method you provide, (2) the payment information you provide is true, correct and complete, and (3) you will pay all charges incurred at the posted prices, including shipping charges.
6. Shipping and delivery
We currently ship within the Republic of Türkiye. Estimated processing and delivery times are stated in our Shipping Policy. In any case, your order will be delivered within the legal maximum of 30 days, unless otherwise agreed.
In accordance with Turkish law, the risk of loss or damage remains with us until the products are delivered to you or to a person you designate (other than the carrier). Please check your package on delivery and, if the package is visibly damaged, ask the carrier to prepare a damage report (hasar tespit tutanağı) and contact us.
We are not responsible for delays caused by events beyond our reasonable control, including natural disasters, severe weather, carrier disruptions, labor disputes, governmental actions or similar events. See our Shipping Policy for more details.
7. Intellectual property
Our Services, including all trademarks, brand names, logos, text, images, graphics, product descriptions, videos and audio, are owned by Miraç Palm, its affiliates or licensors and are protected by Turkish and international trademark, copyright and other intellectual property laws. The purchase of any product does not grant you any intellectual property rights in the product, its design or packaging.
You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Miraç Palm's names, logos, product names, designs and slogans are trademarks of Miraç Palm and may not be used without our prior written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names and logos on the Services are the trademarks of their respective owners.
8. Optional tools
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. Such tools are provided "as is" and "as available" without any warranties or endorsement. Any use of optional third-party tools is at your own risk, and you should review the terms on which they are provided by the relevant third party. New features we may offer in the future are also subject to these Terms of Service.
9. Third-party links
The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of third-party websites, and we are not liable for any harm related to your access to them or any purchases you make on them. Please review third-party policies before engaging in any transaction. Questions regarding third-party products should be directed to the third party.
10. Relationship with Shopify
Miraç Palm is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Miraç Palm. Shopify is not responsible for any aspect of sales between you and Miraç Palm, and you release Shopify and its affiliates from all claims arising from your purchases and transactions with Miraç Palm.
11. Privacy policy
Our Privacy Policy explains how we collect, use and protect your personal data in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK). Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information about your use of the Services, including your transactions, in order to provide, secure and improve the Services and prevent fraud. This information may be shared with service providers located outside Türkiye in order to provide the Services. Please review our Privacy Policy and Shopify's privacy policy for more details.
12. Feedback and reviews
If you submit reviews, ideas, suggestions or other content ("Feedback"), you grant us a worldwide, royalty-free license to use, reproduce, publish and display such Feedback for the purpose of operating and promoting the Services. You represent that your Feedback is your own, truthful, does not infringe any third-party rights, and does not contain unlawful, offensive or misleading content. We may, but are not obliged to, monitor, edit or remove Feedback that violates these Terms of Service.
13. Errors, inaccuracies and omissions
Occasionally, information on the Services may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We reserve the right to correct such errors and to update information or cancel orders if information is inaccurate, including after an order is submitted. If we cancel an order after payment has been collected, we will refund you in full within 14 days.
14. Prohibited uses
You may use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame or harm any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited advertising; (g) to impersonate any person or entity; (h) to upload viruses or malicious code; (i) to copy, scrape or resell any part of the Services using robots, scraping tools or automated means; or (j) to interfere with or bypass the security features of the Services. We reserve the right to suspend or terminate your access if you violate these Terms.
15. Agents
If you use or allow any software or service that acts autonomously on your behalf (an "Agent") to access the Services, the Agent must clearly identify itself as an Agent, must not conceal that its access is automated or circumvent any measures intended to distinguish humans from computers, and must comply with any limits we set. We may limit or block Agent access to the Services at any time.
16. Termination
We may terminate this agreement or your access to the Services at any time in our sole discretion, subject to applicable law. You will remain liable for all amounts due up to the date of termination. Sections that by their nature should survive termination will continue to apply.
17. Disclaimer of warranties
Except as expressly stated by Miraç Palm and except for the rights you have under mandatory consumer protection law, the Services are provided "as is" and "as available". We do not guarantee that the Services will be uninterrupted, secure or error-free. Nothing in this section limits your statutory rights regarding defective products under Turkish Consumer Protection Law No. 6502.
18. Limitation of liability
To the fullest extent permitted by law, Miraç Palm, its partners, directors, employees, affiliates and service providers, and Shopify and its affiliates, shall not be liable for any indirect, incidental, special or consequential damages, including lost profits or lost data, arising from your use of the Services. Nothing in these Terms of Service excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for defective products or for damage caused by gross negligence or wilful misconduct.
19. Indemnification
You agree to indemnify and hold harmless Miraç Palm, Shopify and their affiliates from any third-party claims, losses or damages arising from (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services, to the extent permitted by applicable law.
20. Severability
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, it shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full effect. If any part of these Terms conflicts with your mandatory consumer rights, those rights will apply.
21. Waiver; entire agreement
Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of that right. These Terms of Service, together with our policies, the Preliminary Information Form and the Distance Sales Contract, constitute the entire agreement between you and us regarding your use of the Services.
22. Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms to a successor business, provided this does not reduce your rights as a consumer.
23. Governing law and disputes
These Terms of Service are governed by the laws of the Republic of Türkiye. For consumer complaints, you may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court (Tüketici Mahkemesi) at your place of residence or where the transaction took place, within the monetary limits set annually by the Ministry of Trade.
24. Language
These Terms of Service may be available in Turkish and English. Where Turkish law requires it, the Turkish version shall prevail.
25. Electronic communications
By using the Services or placing an order, you agree that we may send you order- and service-related communications electronically, by email, SMS or notices on the Services. Commercial and marketing messages are only sent with your prior consent, in accordance with Law No. 6563 on the Regulation of Electronic Commerce, and you may opt out at any time.

You can review the most current version of the Terms of Service at any time on this page. We may update these Terms of Service by posting changes on our website. The version in force at the time you place your order applies to that order.
